Referred to below as "we", "us", "our", "Jacked Empire" or "MentallyJacked". You are referred to as "you", "the user" or "the subscriber".
2.1 By accessing or using this website you enter into a binding agreement with us on these terms. If you do not accept them, you must not use the website.
2.2 You must be at least 18 years old and legally competent to contract under the Indian Contract Act, 1872. By using the website you represent and warrant that you meet both requirements.
2.3 You must not be barred from receiving services under any applicable law.
2.4 You agree to provide accurate information and to keep your account details current. You are solely responsible for all activity under your account and for keeping your credentials secure.
3.1 We provide access to educational content, written guides, and interactive educational calculators on a subscription basis.
3.2 We provide information. We do not provide medical services, healthcare services, clinical advice, diagnosis, treatment, prescription, coaching supervision of a clinical nature, or any regulated professional service.

3.4 We sell no physical goods, no pharmaceutical substances, no supplements and no controlled items through this website.
4.1 Access to certain content requires a paid subscription. Prices are displayed at the point of purchase and are inclusive or exclusive of applicable taxes as stated there.
4.2 Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By subscribing you authorise recurring charges to your chosen payment method.
4.3 You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access until that date.
4.4 Our Refund & Cancellation Policy applies to all payments and is incorporated into these Terms by reference.
4.5 We may change pricing on not less than thirty days' notice to existing subscribers. Changes take effect from your next renewal. Continued use after a price change constitutes acceptance.
4.6 Payments are processed by third-party payment gateways. We do not store your card details. Their terms apply to the payment transaction itself.
4.7 We may suspend or terminate access immediately for non-payment, for breach of these Terms, or where we reasonably suspect fraudulent or unlawful activity, without refund.
5.1 Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access the content for your own private, non-commercial use.
5.2 That licence is for you alone. It confers no right of ownership in anything.

7.1 All content on this website, including text, guides, calculators, algorithms, scoring models, databases, graphics, design, code, compilations and the arrangement of all of it, is owned by us or licensed to us and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international treaties.
7.2 The calculators and their underlying logic, weightings, reference data and scoring models are our original work and constitute protected intellectual property and confidential business information. The absence of a patent does not diminish this.
7.3 "MentallyJacked" and associated marks and logos are ours. Nothing in these Terms grants you any right to use them.
7.4 Unauthorised reproduction or distribution may constitute copyright infringement under the Copyright Act, 1957, and may attract civil and criminal liability.
8.1 Where the website permits you to submit content, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce and display it in connection with operating the website.
8.2 You warrant that anything you submit is yours to submit, is lawful, and does not infringe any third-party right.
8.3 You must not submit anything unlawful, defamatory, obscene, threatening, harassing, misleading, or which offers or solicits any pharmaceutical or controlled substance.
8.4 We may remove any content at our discretion without notice.
8.5 If you are a member of our paid Community room, your participation is additionally governed by the room's posted rules and moderation policy. Content that breaches those rules may be masked or removed, and may result in a warning, a temporary mute, a temporary ban or a permanent ban at our discretion, depending on the rule breached.
8.6 Choosing to post a question anonymously hides your identity from other members. It does not hide it from us. We retain the identity behind every anonymous question and may resolve it internally for moderation purposes; every such lookup is logged.
8.7 Misuse of the report function, including bad-faith or repeated false reports against another member, is itself a breach of these Terms and may result in suspension.
8.8 A question you ask may be answered and archived by us as part of the permanent Community answer archive. Once archived, it remains visible to other members even after your account is suspended, banned or closed, as it forms part of the shared archive other members rely on.
The website and all content are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied.
We do not warrant that the website will be uninterrupted, timely, secure or error-free; that any content is accurate, complete or current; that any calculator output is correct or applicable to you; or that any result will be achieved.
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement.
10.1 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, data, goodwill or opportunity, arising from or connected with your use of the website.
10.2 We shall not be liable for any personal injury, illness, disability or death arising from your application of any information obtained here.
10.3 Where liability cannot lawfully be excluded, our total aggregate liability is limited to the amount you actually paid us in the twelve months immediately preceding the event giving rise to the claim.
10.4 These limitations apply regardless of the form of action and survive termination.
You agree to indemnify, defend and hold harmless MentallyJacked, its proprietor, employees, contributors and agents against all claims, demands, proceedings, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your use of the website, your breach of these Terms, your violation of any law, or your infringement of any third-party right.
The website may link to third-party sites, studies or resources. We do not control them, do not endorse them, and accept no responsibility for their content, accuracy, availability or practices. Any dealing with a third party is solely between you and them.
13.1 We may suspend or terminate your access at any time, with or without cause and with or without notice.
13.2 Where termination is for your breach, no refund is payable.
13.3 On termination your licence ends immediately and you must cease all use of the content.
13.4 Clauses relating to intellectual property, disclaimers, limitation of liability, indemnity, governing law and dispute resolution survive termination.
We may amend these Terms at any time. The current version is always published on this page with its version number and date. Material changes will be notified by email to registered subscribers not less than fifteen days before taking effect. Continued use after that date constitutes acceptance. If you do not accept an amendment, your remedy is to cancel.
We are not liable for any failure or delay caused by events beyond our reasonable control, including act of God, natural disaster, epidemic, war, civil unrest, government action, change in law, failure of telecommunications or internet infrastructure, power failure, cyber attack or hosting provider failure.
16.1 These Terms are governed by and construed in accordance with the laws of India.
16.2 Subject to clause 16.3, the courts at Gurugram, Haryana, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, to the exclusion of any other forum.
16.3 Any dispute shall first be attempted to be resolved amicably. Failing resolution within thirty days, it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurugram, Haryana. The language shall be English. The award shall be final and binding.
16.4 Nothing in this clause limits any right you may have to approach a consumer forum under the Consumer Protection Act, 2019.
17.1 Severability. If any provision is held invalid or unenforceable, it shall be severed and the remainder shall continue in full force.
17.2 No waiver. Failure to enforce any provision is not a waiver of it.
17.3 Entire agreement. These Terms, together with the Medical Disclaimer, Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between us and supersede all prior understandings.
17.4 Assignment. You may not assign your rights. We may assign ours on notice.
17.5 Language. These Terms are executed in English. Any translation is for convenience only and the English version prevails.
